Real inventors will tell you large multinational repeat infringers know little about invention. But they know a lot about invention THEFT. They have in no small measure built their fortunes on theft of our inventions. All their bills like AIA ever do is make it easier for them to rob and crush us. That’s why small entity issued patents and filed applications are now down to about 10% of their historical shares, if not less and still falling. The truth is our large competitor infringers make little or nothing in America while stopping the true creators of truly inventive technologies from doing so. Patents don’t hinder innovation, only theft of.
For example, according to the federal dockets of the 14 patent infringement cases Google has been a party to since Jan 2017, in every case they were a defendant. In all but 1 they were THE defendant. That’s pretty typical of the large multinationals pushing what they call patent ‘reform’. Apparently, no one uses all their thousands of patents or inventions, not even them. As we say, there are patents and then there are Patents. If not for a court and patent system that now enables and even encourages invention theft, we expect there would be far more suits they were a defendant in. But what’s the point in suing them when we only have a 3% chance of succeeding through appeal? Even then our damages in the rare occasion we do win are whittled down from a large oak tree by the CAFC to a match stick. Inventors would be better off if they used that match stick to burn their patents for the little good they do us.
No doubt many inventors would rather use that match to burn these large thieves’ houses then tar and feather the occupants. To paraphrase Poor Richard, ‘where there are courts without justice there will be justice without courts’. We hope that is not where all this will end. The Federal Government (all 3 branches) needs to stop working for thieves, or they should be restructured to restore honest government. They are not now.
Sure these large multinationals commercialize inventions…OURS!
